Definitions

In these Terms and Conditions, the following expressions carry the meanings set out below unless context requires otherwise:

"Agreement"

The binding arrangement formed between Carviste and the Renter upon acceptance of a booking, incorporating these Terms and Conditions alongside any booking confirmation issued by us.

"Carviste" / "We" / "Us" / "Our"

Refers to the business operating under the name Carviste, located at 22 Jalan Mamanda 7, Taman Dato Ahmad Razali, 68000 Ampang, Selangor, Malaysia.

"Renter" / "You" / "Your"

Any individual or entity that submits a rental enquiry, completes a booking, or takes possession of a vehicle provided by Carviste.

"Vehicle"

Any motor vehicle made available for rental under a Carviste weekly plan, inclusive of the Compact, Mid-Tier, and Premium Weekly Plans.

"Rental Period"

The seven-day duration during which the Renter has authorised use of the Vehicle, beginning at the agreed handover time and concluding at the agreed return time.

"Site"

The Carviste website accessible at www.carviste.pro and all associated pages.

Acceptance of Terms

Use of the Site or submission of a booking enquiry constitutes your acceptance of these Terms and Conditions in their entirety. If you do not accept these terms, you should not proceed with any enquiry or booking.

• You must be at least 21 years of age to rent a vehicle from Carviste. Renters aged 21–24 may be subject to additional requirements at our discretion.
• You confirm that you hold a current, valid driving licence issued in Malaysia or an internationally recognised equivalent, and that the licence permits you to operate the class of vehicle being rented.
• You have the legal capacity to enter into a binding agreement and are not acting under any restriction that would prevent you from doing so.
• Where you are booking on behalf of a third party or company, you confirm you have the authority to bind that party to these terms.

Service Description

Carviste offers weekly car rental plans to individuals and organisations operating within Malaysia. Our three current weekly plans are:

We operate primarily within the Klang Valley and surrounding areas of Selangor. Requests outside this catchment area may be considered on a case-by-case basis. Vehicle availability is subject to confirmation at the time of booking.

Booking & Reservation

A reservation is considered confirmed only upon receipt of a written booking confirmation from Carviste. Submission of an enquiry does not itself constitute a confirmed booking.

• You are responsible for providing accurate and complete information at the time of booking, including your name, contact details, valid driving licence number, and intended use of the vehicle.
• Carviste reserves the right to decline any booking at our discretion, including where the information provided cannot be verified.
• Any changes to a confirmed booking, including adjustments to the rental period, vehicle selection, or collection arrangements, should be requested promptly in writing. Changes are subject to availability and may affect the applicable rate.
• Cancellation terms will be communicated at the time of booking confirmation. We ask that cancellations be made with reasonable notice wherever possible.

Renter Responsibilities

During the Rental Period, you accept full responsibility for the Vehicle and its safe operation. Specifically, you agree to:

• Operate the Vehicle in accordance with all applicable Malaysian road traffic laws, regulations, and licensing requirements at all times.
• Return the Vehicle in the same condition as received, normal wear and tear excepted, and at the agreed return time and location.
• Notify Carviste promptly in the event of any accident, damage, breakdown, theft, or third-party involvement involving the Vehicle during the Rental Period.
• Maintain adequate fuel levels and attend to routine operational needs of the Vehicle, such as tyre pressure checks, as reasonably expected of a careful driver.
• Not allow any individual not named or approved in the booking to operate the Vehicle unless prior written authorisation has been obtained from Carviste.
• Not transport the Vehicle outside Peninsular Malaysia without prior written consent from Carviste.
• Keep the Vehicle reasonably clean during the Rental Period and ensure no lasting odour, staining, or damage results from your use.

Prohibited Use

The Vehicle must not be used for any of the following purposes:

• Participation in any motorsport, racing, or organised speed event.
• Transporting goods or passengers for commercial reward, including ride-hailing or delivery activities, unless expressly agreed upon in writing.
• Operating the Vehicle while under the influence of alcohol, controlled substances, or any medication that impairs the ability to drive.
• Use on unpaved, off-road, or flood-prone terrain unless the Vehicle has been explicitly designated for such use in the booking confirmation.
• Transporting hazardous, flammable, or illegal materials.
• Sub-letting, re-hiring, or otherwise transferring possession of the Vehicle to any other party.

Breach of these restrictions may result in immediate termination of the rental arrangement and recovery of the Vehicle at the Renter's cost.

Intellectual Property

All content on the Carviste Site — including text, images, brand marks, layout, and related materials — remains the property of Carviste or its licensors and is protected under applicable Malaysian intellectual property laws.

• You are granted a limited, non-transferable licence to access and browse the Site for personal, non-commercial purposes only.
• You may not reproduce, distribute, modify, or publicly display any portion of the Site without our prior written consent.
• The Carviste name, logo, and associated marks are proprietary identifiers. Use of these marks without authorisation is not permitted.

Payment Terms

All amounts are quoted and payable in Malaysian Ringgit (RM). The applicable plan rate will be confirmed in writing prior to the start of the Rental Period.

• Payment arrangements and accepted methods will be communicated at the time of booking confirmation.
• A refundable security deposit may be required prior to vehicle handover. The amount and conditions for its return will be specified in the booking confirmation.
• Any charges arising from damage, traffic or parking infringements, tolls, or excess mileage during the Rental Period remain the Renter's responsibility and may be deducted from the security deposit or invoiced separately.
• Late return of the Vehicle beyond the agreed window may result in additional charges as outlined in the booking confirmation.
• Refunds, where applicable, will be processed using the original payment method within a reasonable period.

Vehicle-Specific Terms

Additional terms apply in relation to the condition and care of the Vehicle throughout the Rental Period:

• A vehicle condition check will be conducted at the time of handover. You are encouraged to review the condition report carefully before signing and to raise any discrepancies immediately.
• Where a mid-week vehicle check is included in your selected plan, Carviste may conduct a brief inspection to confirm the vehicle's operational state. This does not constitute a waiver of your responsibilities for its condition.
• For plans including door-step delivery and pickup (Premium Weekly Plan), you should ensure a suitable and accessible location is available for handover at the agreed time.
• The end-of-week written vehicle summary provided under the Premium Weekly Plan is for informational purposes and documents the vehicle's condition at return.
• Carviste will endeavour to provide the vehicle model or class confirmed at booking. In the event of an unavoidable substitution, we will provide a vehicle of equivalent or superior category where reasonably possible.

Disclaimers

Our services are provided on the basis described in these Terms and in the relevant booking confirmation. While we take reasonable care in maintaining our fleet and delivering a consistent service experience, please note the following:

• We do not represent that vehicle availability will always be continuous or uninterrupted, particularly during periods of high demand or unforeseen operational circumstances.
• Information on the Site is provided for general purposes and is subject to change. We recommend confirming specific details directly with our team before finalising a booking.
• Nothing in these Terms constitutes professional legal, financial, or insurance advice. You should seek independent guidance on matters of that nature.
• To the extent permitted under Malaysian consumer protection laws, the Site and its contents are provided without warranties of any kind, express or implied.

Limitation of Liability

To the fullest extent permitted by Malaysian law, Carviste's liability to you in connection with these Terms, any booking, or any vehicle rental shall be subject to the following limitations:

• Our total liability for any claim shall not exceed the total amount paid by you for the specific Rental Period to which the claim relates.
• We shall not be liable for any indirect, consequential, or special losses arising from your use of the Vehicle or the Site, including loss of income or loss of opportunity.
• We are not responsible for any items left in the Vehicle during or after the Rental Period. You should ensure personal belongings are removed at the time of return.
• Events outside our reasonable control — including adverse weather, road closures, regulatory action, or other force majeure circumstances — will not give rise to liability on our part.

Nothing in this section limits or excludes liability for death, personal injury, or fraud, nor any statutory rights you hold under the Consumer Protection Act 1999 (Malaysia) or equivalent legislation.

Indemnification

You agree to indemnify and hold Carviste, its staff, and representatives harmless from any claims, damages, costs, or legal expenses arising from:

• Your use of the Vehicle in breach of these Terms or in violation of any applicable law or road regulation.
• Damage caused to the Vehicle or to third parties during the Rental Period where such damage results from your actions or omissions.
• Any misrepresentation made by you in the course of making or maintaining a booking.
• Unauthorised use of the Vehicle by a third party facilitated by your actions or negligence.

Termination

Either party may bring the rental arrangement to an early close under certain circumstances:

• By Carviste: We may terminate the Agreement with immediate effect and arrange recovery of the Vehicle if you breach any material provision of these Terms, including prohibited use, failure to pay, or provision of false information.
• By the Renter: You may request early return of the Vehicle at any time. Whether any portion of the rental fee is returned in such circumstances will depend on the terms communicated in your booking confirmation.
• Provisions relating to payment obligations, liability, indemnification, and dispute resolution shall survive the end of the Rental Period or termination of the Agreement.

Dispute Resolution

We prefer to resolve any concerns through open and direct communication. If you have a complaint or dispute relating to our services, please reach out to us first so we can explore a resolution together.

• These Terms and any dispute arising from them are governed by the laws of Malaysia.
• The courts of Malaysia shall have exclusive jurisdiction over any dispute that cannot be resolved by mutual agreement.
• Where appropriate and agreed by both parties, mediation may be explored as a less formal route to resolution prior to court proceedings.
• Your rights under the Consumer Protection Act 1999 (Malaysia) and any other applicable consumer legislation are not affected by these Terms.

General Provisions

• Entire Agreement: These Terms, together with the booking confirmation, constitute the complete agreement between the parties for the relevant Rental Period and supersede any prior discussions.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full effect.
• Waiver: Our failure to enforce any provision at any time does not constitute a waiver of our right to enforce that provision in future.
• Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may transfer our obligations to a suitable successor without restriction.
• Notices: Formal notices to Carviste should be sent to our business address or email below. We may send notices to the contact details you provide at booking.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal obligations, or operational practices. The current version will always be available on the Site with its effective date noted at the top of this page.

We encourage you to review these Terms periodically. Continued use of our services following any update constitutes acceptance of the revised Terms. For bookings confirmed prior to an update, the Terms in effect at the time of booking will generally apply for that Rental Period.
